AG Labrador Announces over $400 Million in Settlements in Generic Drug Conspiracies to Inflate Prices, Limit Competition; Urges Idahoans to File for Compensation

Home Newsroom AG Labrador Announces over $400 Million in Settlements in Generic Drug Conspiracies to Inflate Prices, Limit Competition; Urges Idahoans to File for Compensation

BOISE, ID —  Attorney General Raúl Labrador today announced that Idaho joined over 40 states and territories seeking court approval of a $400 million settlement with Sandoz Inc. and Fougera Pharmaceuticals Inc., and separate settlements with Ascend Laboratories, Citron Pharma, and Mayne Pharma, to resolve allegations that these generic drug manufacturers engaged in widespread, long-running conspiracies to artificially inflate and manipulate prices, reduce competition, and unreasonably restrain trade with regard to numerous generic prescription drugs. Motions for preliminary approval of these settlements have been filed in the United States District Court for the District of Connecticut.

“Sandoz, Ascend, Citron, and Mayne conspired to rig prices and eliminate competition, forcing Idaho consumers to pay artificially inflated costs for critical medications,” said Attorney General Labrador. “We will continue to pursue corporate defendants who participated in this illegal scheme that harms our families. Any Idahoan who paid for these generic drugs should file a claim for compensation.”

Under the terms of this agreement and previous settlements Sandoz reached with other states, Sandoz will pay a total of approximately $469 million to settle the claims brought by state enforcers. The settlement will also resolve allegations that Sandoz Inc.’s past and present international affiliates, Novartis AG, Sandoz AG, and Sandoz Group AG, participated in the alleged anticompetitive conduct and fraudulently transferred assets to avoid liability. As part of the settlement, Sandoz has agreed to meaningful injunctive terms including a series of internal reforms to ensure fair competition and compliance with antitrust laws.

Ascend will pay $400,000 to the states. Mayne will pay $650,000. Citron’s settlement only includes non-monetary terms as it has ceased business operations. As part of the settlements, the companies each agreed to meaningful injunctive terms including a series of internal reforms to ensure fair competition and compliance with antitrust laws.

These settlements follow previously announced settlements with Glenmark, Lannett, Bausch, Apotex, and Heritage (including Heritage’s parent company, Emcure). The total for all the settlements announced thus far is just under $500 million.

Idaho is one of only two states in the multistate coalition that also secured restitution for businesses impacted by the price-fixing conspiracies. The vast majority of funds obtained in these settlements will go to the direct compensation of individuals, businesses, and agencies which purchased these generic drugs at inflated prices. Idahoans who purchased a generic prescription drug listed here between May 2009 and December 2019 may be eligible for compensation.

Businesses in Idaho that indirectly purchased (i.e., purchased the drug from someone other than the manufacturer), paid for, and/or provided reimbursement for some or all of the purchase price for one of more of the generic prescription drugs listed here between May 2009 and December 2019 may also be eligible for compensation.
